Adult Guardianship

Important Update:Transition Arrangements for Guardianship Applications July 2016

The Guardianship of Adults Act 2016 (the new Act) is expected to commence on 28 July 2016.  The following changes relate to application lodgement that is not of an urgent nature. 

New applications

Once the new Act starts, NT Civil and Administrative Tribunal (NTCAT) will take over legal responsibilities for guardianship orders from the Local Court.

  • In order to transfer jurisdiction from the Local Court to NTCAT, the Executive Office of Adult Guardianship (EOAG) will only be accepting new applications up until Friday 8 July 2016
  • On Thursday 14 July 2016 a new guardianship application form will be available on the NTCAT website.  Please make sure you use the specialised NTCAT guardianship application form for all new guardianship matters from 14 July 2016.
  • Applications can only be made through NTCAT from 28 July 2016 when jurisdiction is transferred.

Applications in progress

All existing guardianship applications that are not determined by the Local Court before 28 July 2016 will be transferred from the EOAG to NTCAT and dealt with under the new Act.

Urgent applications

Urgent applications will follow the usual process through the EOAG until 14 July 2016.  Then:

  • from 14 July 2016 all applications need to be on the form available from NTCAT (contact details below) but can be lodged with EOAG
  • from 28 July 2016 when jurisdiction is transferred applications can only be made through NTCAT.

Guardianship of Adults Bill 2016

Public consultation for the new legislation to reform and modernise adult guardianship in the Northern Territory was completed in March 2016.

On 24 May 2016 the Bill was debated and passed.

The proposed law is known as the Guardianship of Adults Bill 2016:

The Bill aims to provide a contemporary decision-making framework for Adult Guardianship in the Northern Territory recognising the overall wellbeing, human rights and fundamental freedoms of adults with impaired decision making capacity. It will align with the United Nations Convention on the Rights of a Person with Disabilities.
